Criminal History Records Information Checks Policy


Purpose:

This policy describes how Winona State University (WSU) implements fingerprint-based state and national criminal history record checks conducted for non-criminal justice purposes when requested under applicable federal authority and/or state statute to ensure the health and safety of all members of the WSU community.

Policy:

WSU requires Criminal History Records Information (CHRI) checks for certain WSU students, faculty, staff, and volunteers for employment purposes. Fingerprint-based CHRI checks will only be conducted as authorized by the Federal Bureau of Investigation (FBI) and Minnesota Bureau of Criminal Apprehension (BCA), in accordance with all applicable state and federal rules and regulations. Individuals required to submit to a fingerprint-based state and/or national criminal history record check are informed of this requirement and instructed on how to comply with the law, including information on the procedure for submitting fingerprints.

Criminal history records information includes arrest information and corresponding disposition information submitted by federal, state, local, tribal, and certain foreign criminal justice agencies.

[5-17] Kari Koskinen Act:

Minnesota Statute 299C.66-299C.71, Kari Koskinen Act, requires background checks on all managers of apartment buildings and other dwellings. At WSU, this applies to all newly hired employees (including student workers) with access to residence hall rooms, such as Facilities Services and Housing employees.
